Actor Jamie Foxx became the latest celebrity to have been accused of a crime under the Adult Survivors Act (ASA), which is scheduled to expire today 11/23/2023. In a nutshell, the ASA opened a 1-year window for adult survivors of sexual assault to sue their abusers…..regardless of when the alleged abuse happened.

A report from the NY Daily News said the alleged assault is reported to have happened at a rooftop party in New York back in 2015 at Catch NYC & Roof, according to a suit that was filed in New York Supreme Court by a victim who has only been identified as “Jane Doe” at this time.

In the suit, defendant John Doe claims: she found herself sitting next to foxx at the venue around 11 p.m. At around 1 a.m. Doe’s friend reportedly walked over to Foxx’s table and asked for a photo. Foxx’s response was allegedly “Sure baby, anything for you”. Foxx then turned his attention to Doe, saying “Wow you have that supermodel body”. The suit also claims that Foxx told her she looked like Gabrielle Union. The suit says Foxx then grabbed the defendant by the arm and led her to a secluded area of the rooftop restaurant. He then placed both of his hands on the defendant’s waist before moving his hands up her crop top and making his way to her breast. Where he is alleged to have rubbed them (her breast). The plaintiff said she was taken by surprise by Foxx’s actions and she looked over at a security guard at the venue for help, only to see him walk away after noticing them. Foxx then proceeded to put his hands down her pants and put his fingers on and in Doe’s vagina and anus, according to the lawsuit.

Doe said the incident only stopped when her friend came walking in their direction. In the suit Doe claims to have suffered, and continues to suffer from severe emotional distress and anxiety. Doe is demanding an undisclosed amount in compensatory and punitive damages.

Foxx is just the latest celebrity to be sued due to the ASA. The list includes current Mayor of New York, Eric Adams, who is being accused of sexual assault by a former colleague from an incident that happened in 1993. Sean “puffy” Combs, who was accused of rape and abuse by his former girlfriend Cassie Ventura. And in another notable case directly related to the ASA, actor Cuba Gooding Jr. has been accused of sexual abuse by two women who had previously filed suits against the actor in the incident that occurred in NYC in 2018.
